ok ive been on a speed test site,
as im getting cable in a few weeks,
so just for fun i tryed my 56k to see how fast it is,
the test said:: 23KBPS. tryed it 2nd time= 35kbps, 3rd time i tryed it gave me=46kbps???????
is this right for a 56k.
is it true that the lowest i can expect from a cable modem is 40kbps.

If your modem is "56K", interpret it as "not faster than 56K". The actual trasmissin speed is measured for a given packet, i.e. for a given moment, for a given site, etc.
The actual surfing speed will depend on many factors, but the averages will be higher with the cable, of couse.

a 56k, can theoreticaly go 7KB/s, but no faster, but its less due to line degredation and u never really connect at 56k, more like 50k...there is no limit to how low a cable modem can go..depends on what ur dling off of and when
