I am so upset! We put $1500 into it in th last 3 months and everything was fine and dandy........... and plow! this dude in a monster litfed chevy truck slacked into me in our apartment complex! I was making a right turn, and he plowed in to me head on and said he was going straight( he was on my right) and he was on the WRONG SIDE OF THE ROAD!!! I called him today and he does think its his fault.
I called him because when I called his insurance they said there is an issue with his coverage and I have to wait until tomorrow to talk to a claim investigator
:confused: When he called he said I am supposed to call my insurance and he should call his and they will fix it. I said No it does not work like that! He said they cops didn't say whos fault it is who we fix our own cars. He has a scrach in his bumber and my car is totalled. My bumber was under his wheel when he hit me. And my car smoked and and died and it really bad
I HAVE PICTURES ON A DISK HERE RIGHT NOW, CAN SOME SHOW ME HOW TO POST THEM??? There was a neighbor who came out and let us use their digital camera.

Ouch....feel for ya. Just several months ago, my Jeep got major damage by someone else....first accident ever for me. Sickening. First new vehicle I had also....and only half paid off so far.

Oh man, that's tough when it's on private property. You've got to let the insurance companies fight it out.

call that fuxor back and tell him, in an accident that was clearly his fault, you have a neck injury and your attorney wants to sue for $3,000,000.00 but you'll settle for $300.00 if he'll just pay for damages to your car + your $300 dollar Dr. bill.

As for the insurance, you report it to your insurance. Give them the guys name, address and Phone# plus the name of his insurance company.

If you have full coverage, your insurance company will pay to fix your car and then collect it back from his insurance. If you have liability only, you may need a lawyer because his insurance is already making excuses. DO NOT TALK TO THEM. Get advice from your own insurance company and lawyer if you hire one.

wow that really sux bad... I was just in a car accident too! how ironic. My little car wasn't totaled, but it sure did take a lot of dammage, and the other guys car only got scratched! at least I was sitting still and he rammed into me.

You do not call HIS insurance company.

You call YOURS.

HIS insurance company will come up with all kinds of reasons to lowball the repair or cost of the vehicle. It's in their interest to give you as little out of this as possible.

YOUR insurance company doesn't want to pay for the sun and the moon either, but they have a MUCH better chance of getting a real settlement from the other company. They have just as many lawyers on retainer. That's the point. You report it to YOUR company and let THEM fight with the other company.

PS: If you had a sore back anytime in the five days after the accident or if you feel stiff and sore in the neck, GET to your doctor! You can easily herniate or damage a disc in your back or neck and not know it for years. By which point, it's way too late and your HMO will bitch a LOT about having to pay for the surgery to fix the problem.

Don't mess around. If you get sore GO TO YOUR DOCTOR and TELL HIM you were just in an accident and now your back/neck hurts. Understand, it's not about suing the other guy, it's about protecting you.
