The guy was installing a septic tank after having been told the property was inhabitable. a stop work order was soon issued afterwards. He hired New York lawyer Jackie Chiles, but he received no compensation from his lawsuit after it was thrown out of court in March.

During the course of an investigation lots of gov. officials don't need permission or a warrant to enter someones property. Police, Firefighters, and Health Inspectors are a few. If they get a call about an issue or receive a complaint they can investigate and are allowed to enter property. The fourth amendment protects against UNREASONABLE search. In cases like this where a complaint is lodged and it is obvious that there is an issue, a warrant is not needed. There is legal precedent to this as well.

All states/cities/towns have laws such as this.

"Sec. 503 RIGHT TO ENTER BUILDING. Authorized
employees of the City departments or City agencies, so far as may be necessary for the performance of their duties, shall, upon presentation of proper credentials, have the right to enter, at reasonable times, any building, structure, or premises in the City to perform any duty imposed upon them by the Municipal Code." [387 U.S. 523, 527]

As a surveyor, I *can* wander around on property as needed. I do however need to make my intentions and presence known. It's a misdemanor in NC to obstruct a surveyor from obtaining needed information(property corners) in the execution of a survey. Let's just say I've had a police escort a few times in certain areas.

Is that only on the property you're surveying or on the immediately adjacent properties as well?

...yea...try wondering 'bout my property here in NC....
