Cable upload/download limits

I have recently had my upload/download limits set to 1 gig up/5 gig down/month by my cable company due to "abuse of acceptable usage". They are now monitoring me daily. Damn....this is a non-connection to me. I have this great high-speed connection, and now I can't use it. :( Changing ISP's is not an option here. Does anyone know anyway around this? Any help will be appreciated,. :)

If you violated the AUP/TOS, then the ISP have every right to implemet such limits and there's no legal way around them.

How did you violate the AUP/TOS? Were you running a server?

Who's your ISP and what kind of abuse did you commit to warrant such a limit?


My ISP is Cogeco@Home....near Toronto Ontario

They didn't seem to like the fact that I transfered over 70 gig of data in 3 weeks.....

I don't blame them. They probably figure you were running a server of some kind. Were you?

I had an FTP server set up for 2 of my friends to use. (Which I have now closed) Other than that most of the stuff was downloads.... But that's irrelevent really. I simply asked if there was a way around it. Or is my initial feeling on this site correct? This site is just set up by the ISP's themselves? That would be the only logical explaination to all these questions. Yes.....I use my connection a lot.....that's why I got high-speed. If you don't want to help me out that's OK.....I'll get info elsewhere.

You violated the AUP/TOS by running a server. Why do you think you should have the limits removed? My guess is they are implemented on your ISP's side or via the modem's configuration file, so there's no way around them.

Here's the bottom line Vidiot. You have violated the terms of a CONTRACT that YOU signed with your cable company. Sorry, but you can't plead ignorance now saying you didn't know there was a cap on the amount of data you can transfer.

Feel free to take them to court or whatever you feel is necessary, however, you agreed to the contract the second you signed on the dotted line. Contracts are binding, period. Unless the company has decieved you in some way or not provided everything stated in the contract they are within their rights to limit your connection.

If your unhappy with the speeds you get then sign up for a business account that will offer you the things you want. If it's too expensive for a business account then you must work within the terms of your current contract.

This is called life. If you don't like it move to another country where the rules are different or find another means of broadband. The people here are more than happy to help you with any problems you might be having, but the second you start being a smartass you've blacklisted yourself and will get no help here.

When I signed up with my cable company they were advertising UNLIMITED internet access.

Sounds like a limitation to me.....
And they never said any thing about the server.....they were just pissed about all the downloads....

Service agreements aren't verbal. Have you actually read your provider's AUP/TOS, or at least checked to see how it outlined servers? I've never seen a residential cable ISP permit servers of any kind.

Like I said....the server isn't the issue!!!! They were pissed about all the downloads! My server was just used by 2 friends for a few file transfers! The server is NOT the issue here! I signed up for UNLIMITED internet access and now they say it's limited to 5 gig......that's F\/cked.....

(and yes....I have checked the contract.....)

I'm sorry but the server is the only issue here. Servers are not permitted. You ran one and thus, violated the TOS/AUP, a legal agreement. You are now at your provider's mercy and so far I'd say they have been generous, being that you still have service.

I believe you're the one in a coma. Have you not been reading the previous posts? They (the ISP) are [/b]not[/b] required to verbably disclose the TOS/AUP. It's up to the customer to be aware of it and it's contents.

Scan the part of your AUP/TOS where it says unlimited and post a link to the image file here. That will settle it all.

I have been reading thise post for a bit and i have a few things to point out..
1# Vidiot does know what he did to get his connection limited ( thats not what he asking)
2# He asked if there is a way to get around it
3# All that happen was that he was hacked on because of it

Obviously you haven't been reading either. I had Cable installed when they were advertising unlimited internet access .....now they limit me. You can say all you want about contracts and stuff...but if they offer unlimited access, and then limit you, that's false advertising.....

You failed to read the fine print in their advertisement. There's ALWAYS limitations. Always. You just learned a valuable lesson regarding that fact.

As to your original question: There probably is a way around it by hacking into your modem just like some other guys did to remove the speed caps. But, they also got busted, so it's really pointless to try and get around it because you'll get caught at that too and then you'll have no broadband as they will not want you again as a customer.

Do I personally know how to do it? No. Not at this moment, but I could find out that info within a short time. Will I? No, because I have no desire to go against my ISP's AUP and lose my access totally. Sometimes you just gotta play by the rules. It sucks sometimes, but that's life.

But how can it be UNLIMITED with SOME limitations? That makes no sense, and is false advertising....and there was no fine print in the ad.

Anyway, thanks for finally admitting it's possible, but have no interest in finding the details. Finally, I got an honest answer here. This post went alot longer than it should have.....but it was fun non-the-less. :p

Your wounds are self-inflicted.

The transer limits are the result of you violating the service agreement. Your provider had every right to implement those limits, regardless of what was advertised. Why is this so difficult for you to comprehend?

Vidiot :The ANSWER to you QUESTION is yes < you can download or up load past your limits But that not the problem. The problem is that they keep a log on every user not just you. They know every thing that take place on your IP and there is no way around that. You may think that running a server is not a issue but if you had not put a server on your IP they would not be able to limit your down loads and up loads . they put the limits on you to stop you from running a server,that all.So don't run a server or host any games for a few months and they will take the limit off.But try to run a server again they will cut you off or bill you for it
I know that it make you mad but think about all the other people that has to use the same line as you, I bet there mad to. they just don't know who to be mad at. they think it there ISP that bad.

That may have been your original question, but later on your acted as if you had been wronged by your ISP, which isn't the case. If you successfully "get around it", you'll get caught. I guess presume you wish to lose your service altogether?
