BK Law: Another Blow to Katrina Victims
and the hits just keep on coming...
Phew. Good thing Congre$$ didn't include any inconvenient waivers to the new BK law signed into law back in April and set to go into effect 17 October. The impoverished credit card cos. are starving and scrambling to make a buck, after all. Wouldn't want anything like a tsunami of medical bills from a catastrophic illness to impede on the flow of obscene profits, now, would we.

According to whom? Contrary to popular sheeplethink, cr. cd. debt is not due to partying it up. Recheck your sources and determine who bought them off to pay for the perception that you have - Most debtors file BK b/c of medical bills from catastrophic illnesses, not because of allegations of fiscal irresponsibility. And anyway, so what if it is. Look at the federal govt. We're all drowning in an ocean of red ink b/c the pRezdint has us paying for 2 wars, 2 hurricane reconstructs and tax cuts for the mega-wealthy. ok ..you're right and everyone else is wrong .....how many times have you been to a 341 hearing??? ... do you even know what that is?? ..until you do shooosh ...i've sat through hours of hearings in front a US bankruptcy court trustee during the interview process and the lack of responsibility is amazing ..but hey your post makes good fodder ...

Oh man, don't even talk about it. meh ..don't worry about it ...if you wait until after Oct17th ...you'll have more paperwork to fill out and more hoops to jump through ...for example ..your attorney has to 'certify' that there is no abuse taking place--meaning you're not hiding money away--and it will get more expensive to file and some debts won't be so easily dishcharged ... consult an attorney would be my recommendation

I'm hoping I don't have to take that step. I owe no one anything except for that hospital. Seems like a pretty dumb reason to claim bankruptcy under the circumstance, but it depends largely on how bad they want to push for their money. What they want each month and what we can afford to give are two entirely different things.

they can be aggressive ...try and be proactive in establishing arrangments but don't give out too much info ...document everything you can and if possible ...and if you have the resources see if they will settle for a discounted lump sum of money ...

Aside from being part of a BK filing, what, exactly, does a 341 hrg have to do with the topic of this thread, exactly? What does your personal bankruptcy filing have to do with a hurricane victim and/or catastrophic illness as it relates to the new BK law? I tend to think that while the new BR laws were needed, I fail to see where they really got back to the original intent of them. In this case, it's not exactly right that one family who have always kept bills paid, worked hard all their lives and even voted for the cheap bastards who voted for this version of the bill, should have to move to a poor farm while some business who they owed money too, shouldn't suffer at all.
I happen to belive that the rights of the citizens are more important than the rights of corporations. We need to get back to that.

I agree but it is a two way street .....i have 40 active bankruptcies on my books and none of them are because of a genuine problem other than overextending themselves...it's like people forgot how to save money in case of an emergency
The credit card co's DO need to take responsibility for issuing people credit and being more forthcoming with all the details of a persons credit card agreement
after 15 years of seeing this IMHO it boils down to this ...
no one held a gun to your head forcing you to spend money you didn't have

So let's stop giving out home loans and car loans because you never know when something might happen to you. That should fix the ecomomy. 
I'd say that our own goverment's unwillingness to FIX the ecomomy, may very well contribute to a lot of BR. No?
Izzo...yes there are abuses..but imho, lazy lawmakers COULD do something to fix the system instead of catering to their masters...

I'd be supprised if even 25 percent of them were actually paid off. That would give a huge percentage of them as still owing on them. For the most part, most people left pretty much everything they owned in them houses.
By your reasoning, they should still be paying their mortgage even though there's a good chance that they might not ever be able to build on there own land again. They've lost their cars....everything. This is one of the situations that the original law was supposed to help. Now in saying all that, would you still be making your payments on a life you no longer have or will ever have again?

C'mon man .. no but people need to take things into consideration when making large purchases ... insurance ?? disability insurance?? and yes ..after meeting with a number of trustees and attorneys about this legislation it's clear where it originated from .. like i've said in previous posts on this topic ...the poor get the shaft again while the rich benefit ....in a nutshell only those that can afford to file now can..
I used to have a customer that would go into a casino with her husband and write thousands in checks to play then stop payment on them the minute we opened the following morning ..she did this like 3 times before they put an end to it ... after she files shes comes to make a deposit and rolls up in a pimped out Lincoln Navigator ......pff priorities .. some people feel entitled to a certain lifestyle and they'll do whatever it takes to make it happen
oh and MOST CC companies will do whatever they can to make the profit ... goes both ways
