Apple, Samsung renew $1billion patents battle in court

Apple and Samsung renewed their legal spat Thursday in court with a fresh wave of legal arguments from both parties. Samsung seeks to overturn an Aug. 24 jury verdict that found the Korean tech titan ripped off Apple Inc.'s designs for its iPhone and iPad. The jury ordered Samsung to pay Apple $1 billion after finding close to two dozen of its products used technology controlled by Apple.

Samsung says that the jury foreman treated the firm unfairly, and alleges that some of Apple's patents should never have been awarded in the first place, therefore the verdict's damage reward is incorrect. In addition, jury foreman Velvin Hogan is being accused of concealing a former employer on his disclosure documents - Seagate - of which Samsung is a large investing party.

Apple in turn is looking to add $500 million more to the award while barring many of the older Samsung products at issue from sale in the United States.

The case will be heard by the San Jose district judge Lucy Koh today. But whatever she decides is unlikely to be enough. Samsung is believed likely to take the case to the Federal Circuit Court of Appeals - and possibly even all the way to the Supreme Court.
