Microsoft can close its Activision merger, federal judge rules

A federal judge in San Francisco has denied the Federal Trade Commission's motion for a preliminary injunction to stop Microsoft from completing its acquisition of video game publisher Activision Blizzard.

San Francisco-based Judge Jacqueline Scott Corley has ruled that the US Federal Trade Commission was unlikely to be prove that the proposed acquisition or merger would "substantially lessen competition."

"In sum, the FTC has not shown a likelihood of success on its theory the merger may substantially lessen competition in the Gen 9 console market because the combined firm will have the ability and incentive to foreclose Call of Duty from PlayStation," the ruling says in part.

The deal isn't completely in the clear, though. The FTC can now bring the decision to the U.S. Court of Appeals for the 9th Circuit, and the two companies must find a way forward to resolve opposition from the Competition and Markets Authority in the United Kingdom.
